Notice of Privacy Practices

This notice describes how medical and behavioral health information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Our Legal Duty

Rise & Reflect Community Services LLC is a HIPAA-covered entity. We are required by law to maintain the privacy of your Protected Health Information (PHI), to provide you with this Notice, and to abide by its terms. We are also subject to North Carolina's stricter confidentiality protections under NC G.S. 122C-52, which prohibits disclosure of client-identifying information without written consent except in limited circumstances. When NC and federal law differ, we follow the stricter standard.

How We Use Your Information

We may use and disclose your health information for the following primary purposes without your written authorization:

  • Treatment: To provide, coordinate, or manage your behavioral health care and related services, including sharing information with other providers involved in your care.
  • Payment: To bill and collect payment for services, including submitting claims to Medicaid, Medicare, or private insurance.
  • Healthcare Operations: For internal quality improvement, staff training, compliance audits, credentialing, and administrative activities necessary to run our organization.
  • Required by Law: When disclosure is required by federal or North Carolina law, including mandatory reporting obligations (e.g., child abuse under NC G.S. 7B, adult protective services under G.S. 108A, or imminent danger duty-to-warn).
  • Public Health Activities: To prevent or control disease, injury, or disability as required or permitted by public health authorities.
  • Health Oversight: To support government oversight activities such as audits, inspections, or investigations by NCDHHS or the HHS Office for Civil Rights.

Uses Requiring Your Written Authorization

For uses and disclosures beyond those described above, we will obtain your signed written authorization. This includes disclosures of psychotherapy notes, use of your information for marketing, and any sale of your health information. You may revoke your authorization in writing at any time; revocation does not affect disclosures already made in reliance on the authorization.

Website & Online Forms: Our website contact and intake forms are designed to collect general contact information only — not Protected Health Information. Do not include diagnoses, medications, insurance numbers, or other clinical details in online messages. Clinical information is collected only through HIPAA-compliant channels (phone or in-person intake).

Your Rights

You have the following rights regarding your health information held by Rise & Reflect Community Services LLC, protected under HIPAA and NC G.S. 122C.

Right to Access Your Records

You have the right to inspect and obtain a copy of your health information maintained by Rise & Reflect Community Services LLC, with limited exceptions under 45 CFR 164.524 and NC G.S. 122C-53. Written requests will be fulfilled within 30 days.

Right to Request Corrections (Amendment)

If you believe your health information is inaccurate or incomplete, you may request an amendment under 45 CFR 164.526. We will respond within 60 days of receiving your written request.

Right to Request Restrictions

You may request that we restrict certain uses or disclosures of your health information. We are required to agree to restrictions on disclosures to health plans for services you paid for in full out-of-pocket. Other restriction requests are evaluated case by case.

Right to an Accounting of Disclosures

You have the right to receive a list of certain disclosures we have made of your PHI for purposes other than treatment, payment, or healthcare operations, covering the previous six years (45 CFR 164.528).

Right to Be Notified of a Breach

If your unsecured PHI is breached, we are required to notify you without unreasonable delay and within 60 days of discovery, as required by 45 CFR 164.404 (HIPAA Breach Notification Rule).

Right to Receive a Paper Copy

You have the right to receive a paper copy of this Notice of Privacy Practices at any time, even if you have agreed to receive it electronically. Contact us at (252) 572-6547 to request a printed copy.

How to File a Privacy Complaint

If you believe your privacy rights have been violated, you may file a complaint with Rise & Reflect Community Services LLC or with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.

Changes to This Notice

We reserve the right to change the terms of this Notice and to make the new Notice provisions effective for all PHI we maintain. We will post any revised Notice on our website and make paper copies available at our office. The effective date of the most current version is noted at the top of this Notice.
